Greatbatch Sues Pressure Products for Unfair Competition

CLARENCE, N.Y., Jun 21, 2010 (BUSINESS WIRE) --Greatbatch, Ltd. announced today that it has sued Pressure Products Medical Supplies, Inc. in U.S. District Court for the Western District of New York, asserting that Pressure Products violated federal and state unfair competition laws by making deceptive public statements about the company and its introducer products.

In its complaint, Greatbatch states that on June 11, 2010, Pressure Products issued a false and misleading press release regarding a patent infringement case pending in the U.S. District Court for the Eastern District of Texas. The complaint states that Pressure Products' widely disseminated release was intentionally written to cause unfair market and consumer confusion, particularly regarding Greatbatch's new and innovative OptiSeal(TM) valved peelable introducer and its FlowGuard(TM) valved peelable introducer. Greatbatch's proprietary introducers are medical devices that are intended for use in the percutaneous insertion of pacing leads or catheters in the venous system.

The complaint further states: "Pressure Products has distorted both the facts and the law as to Greatbatch's introducer products, and is now waging a public relations campaign based on false statements and innuendos. Greatbatch's customers and the patients whose lives are protected through use of its introducers deserve to have the record set straight and to know that they have lawful access to the medical devices that best serve their medical needs."

Greatbatch's suit is brought for Pressure Products' violations of the federal Lanham Act and New York's General Business Law. Greatbatch is seeking damages, an injunction against further violations of these laws, attorneys' fees and other relief.
